Terms of Service

These Terms of Service ("Terms") govern your access to and use of the PermitDesk website at trypermitdesk.com and the PermitDesk service (together, the "Service"), provided by JS Technology Solutions, Inc. ("JS Technology Solutions", "we", "us", or "our"). By accessing or using the Service, you agree to these Terms. If you are entering into these Terms on behalf of an organization, you represent that you have authority to bind that organization.

1. The Service

PermitDesk helps governments accept, classify, route, and track permit and license applications. The Service is assistive and keeps a person in the loop; it does not itself issue or deny permits or licenses. We may update, improve, or modify the Service from time to time. Specific commercial terms, service levels, and pricing for a paid engagement are set out in the order form, statement of work, or subscription agreement between you and us, which supplement these Terms.

3. Customer data

You retain all rights to the data you, your staff, or applicants submit to the Service ("Customer Data"). You grant us a limited license to process Customer Data solely to provide and support the Service. We do not use Customer Data to train models. Our handling of personal information is described in our Privacy Policy.

4. Fees

Where the Service is provided on a paid basis, fees, billing frequency, and payment terms are as stated in your applicable order form or subscription agreement. Unless stated otherwise, fees are non-refundable except as required by law.

5. Intellectual property

The Service, including its software, design, and content (excluding Customer Data), is owned by JS Technology Solutions and its licensors and is protected by intellectual property laws. These Terms do not grant you any rights in the Service except the limited right to use it as described.

6. Third-party services

The Service may integrate with or link to third-party services, such as payment processors, GIS providers, and finance or records systems. We are not responsible for third-party services, and your use of them is governed by their own terms.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. The Service supports, and does not replace, the judgment and decisions of your staff.

8. Limitation of liability

To the fullest extent permitted by law, JS Technology Solutions will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or relating to the Service. Our total liability for any claim relating to the Service will not exceed the amounts you paid us for the Service in the twelve months before the claim.

9. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or as needed to protect the Service. Provisions that by their nature should survive termination will survive.

10. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws applicable to JS Technology Solutions, Inc., without regard to conflict-of-laws principles, unless a signed agreement between you and us states otherwise.
